Terms & Conditions of Service: ebooks

These Virtual Beauty Corporation Terms and conditions of Service apply to Virtual Beauty Corporation eBooks and printed materials.
For digital content you purchase through the Virtual Beauty Corporation eBooks service (the “Service”), you agree to be bound by the Virtual Beauty Corporation Terms of Services as well as these additional terms.
The Virtual Beauty Corporation Terms of Services and these additional terms shall be the “Terms of Service.” Virtual Beauty Corporation may change the Terms of Service from time to time and post any modified terms at https://www.virtualbeauty.co.nz/Terms & conditions you understand and agree that if you use the Service after the date on which these terms have changed, Virtual Beauty Corporation will treat your use as acceptance of the updated terms.

1. Usage Requirements:
(a) Your experience with our e-books can only be assured if you follow the download instructions provided in your order confirmation or at the help with downloads section of our website.
Virtual Beauty Corporation cannot be responsible for non-delivery of your digital purchases if you do not follow the instructions provided. Following the instructions is your responsibility.
(b) PDF. To be able to read the PDF version of the book you will require at minimum PDF reading software or a suitable plug-in for your web browser.
(c) Rich media flip book. To use the Service, you will need a compatible device, working Internet access, and a HTML 5 compatible browser. Your ability to use the Service and the performance of the Service may be affected by these factors. Such system requirements are your responsibility.

2. Delivery & Retention.
After purchase, you will be able to access the digital content from the links sent to the nominated email address provided at purchase. The PDF version of the e-books is provided with a personalized watermark bearing the purchasers email address, and will be available for download three (3) times only over a period of 12 months. Access to the Flip book is unrestricted.
Confirmation emails are usually received within 2 minutes of registration, however network traffic and individual ISP routing delays may be evident at peak usage times.
Virtual Beauty Corporation will not be held responsible for delays in any activation of reading access due to invalid email addresses being provided or security/privacy settings hampering the delivery of such messages.
Virtual Beauty Corporation will attempt to assist in cases where digital materials have not been received. Assistance can be obtained by using the contact tech support function from the top menu of the website.
It is your responsibility for the safe retention of your digital files. We recommend keeping a backup of your files in a safe place such as cloud storage or a portable storage device. In the instance of permanently lost files, we may (upon proof of purchase by original customer) be able to re-issue access if within 12 months of original purchase.

3. Digital Content.
The Virtual Beauty Corporation eBook website enables you, subject to the restrictions set forth herein, to view, download, display and use on your devices, including but not limited to mobile devices, e-readers, and personal computers (each a “Device”) the digitised electronic content, (eBooks) as determined by Virtual Beauty Corporation (“Digital Content”). Virtual Beauty Corporation may change the entities from which you access the Digital Content from time to time without notice.

4. Use of Digital Content.
Following payment of the applicable fees for an item of Digital Content, for as long as Virtual Beauty Corporation (the applicable copyright holder) has rights to provide you that Digital Content, Virtual Beauty Corporation gives you the non-exclusive right to access, subject to the restrictions set forth herein, the applicable Digital Content on your Devices, and to view, use, and display such Digital Content an unlimited number of times on your Devices or as otherwise authorised by Virtual Beauty Corporation as part of the Service for your personal, non-commercial use.
You are permitted to print a personal copy of the digital files as required but are constrained by the restrictions outlined in section 5. All printed copies must display the license details that appear on the bottom of each page.
If Virtual Beauty Corporation loses the rights to provide you any Digital Content, Virtual Beauty Corporation will cease serving such Digital Content to you and you may lose the ability to use such Digital Content. Capture, select, copy and paste functions are not available on our Digital Content, and otherwise stated you must use the files within the prescribed limits and only for personal non-commercial purposes.

5. Restrictions.
You may not sell, rent, lease, distribute, broadcast, transfer, or assign your rights to the Digital Content or any portion of it to any third party except as expressly permitted by Virtual Beauty Corporation. Provided, however, that nothing in the Terms of Service shall prohibit any uses of Digital Content that would otherwise be permitted under International Copyright Treaties. In addition, you may not remove any watermarks, labels, or other proprietary notices on or in the Digital Content.
You acknowledge and agree that Virtual Beauty Corporation may place limits on the number of Devices and/or software applications you may use to access Digital Content and that such limits may be set by Virtual Beauty Corporation at any time at Virtual Beauty Corporation’s discretion. You acknowledge and agree that Virtual Beauty Corporation may record and store the unique device identifier numbers of your Devices in order to enforce such limits.

6. Security
You understand that the Service and Digital Content provided through the Service utilize technology designed to protect the security of digital information. You may not attempt to, nor assist or encourage others to, circumvent, disable, defeat, reverse-engineer, decompile, or tamper with any of the security features or components related to the Service or Digital Content for any reason. Violations of security features may result in civil or criminal liability.

7. Refunds.
You may cancel access to Digital Content you purchased from the Virtual Beauty Corporation eBooks website for a full refund if the Service does not perform as stated with respect to that purchased Digital Content, provided you have not downloaded the digital materials and Virtual Beauty Corporation receives your refund request within 24 hours of purchase. We can only provide a refund to the same credit card used for the original purchase. Following Virtual Beauty Corporation’s provision of a refund to you, you will no longer have the right to access the applicable Digital Content.  Virtual Beauty Corporation keeps records of all downloads (including IP addresses) in order to provide customer support and protect itself from fraudulent claims.

8. Non-delivery of print versions.
In the event of a non-delivery due to the delivery being rejected for whatever reason, Virtual Beauty Corporation reserves the right to recover the cost of any return from the original purchase price. This cost shall not exceed the original cost of postage/courier charged.

9. Prices & Availability.
Virtual Beauty Corporation retains the right to Change Prices and Availability of Digital Content. Prices and availability of any Digital Content are subject to change at any time.

10. Usage Information
The Virtual Beauty Corporation Privacy Policy describes how we treat personal and certain other information generated by your use of the Service.

11. Service Changes.
Virtual Beauty Corporation shall have the right to suspend, modify, or discontinue the Service at any time without liability to Virtual Beauty Corporation. If Virtual Beauty Corporation elects to discontinue the Service, it shall, if permitted by law, provide prior notice to you of the discontinuance.

12. Termination of Rights.
If you fail to comply with any term of the Terms of Service, Virtual Beauty Corporation may automatically terminate your rights hereunder, including revoking your access to the Service or Digital Content, without notice to you and without refunding any fees paid by you.
Virtual Beauty Corporation’s failure to enforce any term of the Terms of Service will not constitute a waiver of any of its rights or any terms of the Terms of Service.

13. Amendment.
Virtual Beauty Corporation may amend the terms of the Terms of Service at its sole discretion by posting the amended terms on its website. Your continued use of the Service after seven days following the date such amended terms are posted will constitute your acceptance of and agreement to be bound by the amended terms.
